Sowing a Culture of Interdependence
It is extremely unlikely that anyone is going to bring in seeds that are under patent. We are working on revising our seed protocol, we can include that piece in there just so it's clear about what folks should share. Some times when things are under patent, folks can save it for themselves but are not allowed to sell it. I'm not sure if sharing without any financial gain, such as a seed library, is interpreted in the plant breeders protection. I can double check. As I mentioned, it's unlikely that anyone will bring in patented material. The return rate for seeds in general can be pretty low and often it's by folks who have saved seed before and would tend to favor open-pollinated ("heirloom") seeds.
